1. Acceptance of Terms
By accessing and using DirectFile's services, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our services.
2. Description of Services
DirectFile currently provides court document delivery services in Toronto and the GTA. File tracing is planned for a future release. Affidavit of Service is included as a required service component.
3. User Responsibilities
You agree to:
- Provide accurate and complete information for service requests
- Use our services only for lawful purposes
- Not misuse or interfere with our services
- Maintain the confidentiality of your account credentials
- Pay for services rendered in accordance with our pricing
4. Service Limitations
While we strive to complete every service request, successful service depends on factors beyond our control. We do not guarantee:
- That service will be effected on the first attempt
- That the recipient will be located at the provided address
- Specific timeframes for completion (estimated turnaround times are not guaranteed)
5. Payment Terms
Payment is due according to the terms agreed upon at the time of service request. During this launch stage, checkout is processed through Stripe test mode. All prices are in Canadian dollars and subject to applicable taxes.
6. Limitation of Liability
DirectFile's liability is limited to the fees paid for the specific service in question. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
7. Confidentiality
We treat all client information and documents as confidential. We will not disclose information to third parties except as required to complete the service or as required by law.
8. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our website.
